Terms and Conditions
This version of the Terms is effective as of 2025-06-01.
1. Definitions
1.1. Online Store: The online store operated by the Seller, located at: https://www.shiftytech.eu
1.2. Account: The Buyer’s user account in the Online Store, used to make purchases.
1.3. Seller: MB Shiftytech, a company registered in the Republic of Lithuania, legal entity code 307098217, registered address: Sodų g. 9-3, Žiežmariai, Republic of Lithuania, email: info@shiftytech.eu, phone number: +370 67119841.
1.4. Buyer: A natural or legal person who places an order in the Online Store.
1.5. Purchase-Sale Agreement: A remote contract concluded between the Buyer and the Seller using means of communication, under which the Seller sells products to the Buyer at an agreed price. The agreement is deemed concluded from the moment the Buyer clicks the “Confirm” button in the Online Store and remains valid until both parties have fully fulfilled their obligations.
1.6. Order: A declaration of the Buyer’s intention to conclude a Purchase-Sale Agreement using remote means of communication. The Order specifies the products the Buyer intends to purchase and includes the Buyer’s essential data required to conclude the agreement.
1.7. Terms: These terms and conditions for using the Online Store and purchasing goods.
2. General Provisions
2.1. These Terms are a binding legal document establishing the mutual rights, obligations, responsibilities, and other provisions related to the purchase and sale of goods between the Buyer and the Seller. They regulate the conditions for purchasing and paying for goods, delivery and return procedures, and other important aspects. The Terms become a concluded Agreement when the Buyer submits an Order. The version of the Terms valid at the time of the Order shall apply.
2.2. By using the Online Store or purchasing goods, the Buyer or visitor must agree to the Terms and read the Privacy Policy. Confirmation of such is a binding commitment to comply with them. If the user does not read, understand, or agree with the Terms, they are not allowed to use the Online Store or purchase products/services.
2.3. The Seller reserves the right to change, amend, or supplement the Terms at any time. Changes become effective upon being posted in the Online Store. Continued use of the Store after such changes implies acceptance.
2.4. Relations not covered or only partially covered by these Terms are governed by the laws of the Republic of Lithuania.
2.5. The Seller shall not be held liable for consequences arising from the Buyer’s failure to read the Terms, although the opportunity was provided.
2.6. The right to shop in the Online Store is granted to:
2.6.1. Legally capable adults;
2.6.2. Legal entities.
3. Protection of Personal Data
3.1. The Buyer is responsible for the accuracy of the personal data provided (name, surname, delivery address, phone number, email). The Seller is not liable for damages caused by incorrect or incomplete data.
3.2. By confirming these Terms, the Buyer agrees that the provided information may be used for business analysis and direct marketing purposes.
3.3. The Buyer also agrees to receive notifications at their provided email address and phone number if necessary for order execution.
3.4. The Buyer must keep registration and login details confidential and not disclose them to third parties.
4. Buyer’s Rights and Obligations
4.1. The Buyer has the right to purchase goods according to these Terms and the laws of the Republic of Lithuania.
4.2. The Buyer may withdraw from the Purchase-Sale Agreement within 14 days of receiving the goods by notifying the Seller via email and specifying the item and order number. This right is valid if the product is unused, undamaged, and in its original condition.
4.3. The Buyer has the right to return or exchange defective goods.
4.4. The Buyer must pay for the ordered goods and accept them as described in the Terms.
4.5. Upon receiving the goods, the Buyer must inspect them and report any defects according to the Terms.
4.6. The Buyer must promptly update any changes to their registration data.
4.7. The Buyer must ensure the confidentiality of their login credentials.
4.8. By using the Online Store, the Buyer agrees to these Terms and applicable laws.
4.9. The products are reserved and the Agreement is executed only after payment confirmation from the bank. The Buyer must pay within 48 hours of clicking "Place Order." If not, the Seller may consider the Order canceled.
5. Seller’s Rights and Obligations
5.1. The Seller may restrict access to the Online Store without prior notice if the Buyer violates the Terms or laws.
5.2. The Seller may suspend or terminate the operation of the Online Store or change its content at any time.
5.3. The Seller may update the Terms, product range, prices, descriptions, and conditions by publishing changes on the Online Store.
5.4. The Seller must provide access to services as per the Terms.
5.5. The Seller must keep the Buyer’s personal information confidential, in accordance with the Privacy Policy and laws.
5.6. The Seller must deliver ordered goods to the specified address under the agreed conditions.
5.7. If a product cannot be delivered, the Seller must refund the paid amount within 5 working days.
6. Orders, Prices, and Payment
6.1. Product prices are shown in euros including VAT.
6.2. If the Buyer needs more information, they must contact the Seller before ordering. By placing an order, the Buyer confirms that the information is clear and sufficient.
6.3. The Seller is not responsible for slight differences in product appearance due to display or technical factors.
6.4. The Buyer pays via the Paysera website. Payment security is handled by the relevant bank.
6.5. Orders are processed only after payment is received in full.
6.6. The Seller is not responsible for losses caused by third parties involved in the payment process.
7. Delivery of Goods
7.1. Goods are delivered in Lithuania, Estonia, and Latvia.
7.2. Delivery is made by the Seller or a service provider.
7.3. The Buyer must provide the correct delivery address and phone number.
7.4. Delivery methods:
7.4.1. To a selected LP EXPRESS terminal;
7.4.2. To a selected OMNIVA terminal;
7.4.3. To a selected DPD terminal.
7.5. Products are delivered within the timeframes specified in product descriptions.
7.6. The Seller is not liable for delivery delays caused by the Buyer.
7.7. If the Buyer accepts the package without comments, the goods are considered compliant.
7.8. If the package is damaged or incorrect, the Buyer must immediately inform the Seller.
7.9. If no claim is made within 5 calendar days, the goods are deemed compliant.
7.10. If the Buyer fails to fulfill their obligations, the Seller may cancel delivery, terminate the Agreement, and seek compensation.
8. Product Warranty and Expiry
8.1. Product information is provided in each product description.
8.2. Warranty periods and conditions are specified in the descriptions.
9. Returns and Exchanges
9.1. Quality products may be returned within 14 days of delivery.
9.2. Return conditions:
9.2.1. Original, undamaged packaging;
9.2.2. No damage by the Buyer;
9.2.3. Product unused, original appearance intact (labels, films, etc.);
9.2.4. Contents match what was delivered.
9.3. If conditions are met, complete a return request and send to: info@shiftytech.eu
9.4. The Seller will contact the Buyer within 5 working days to coordinate the return.
9.5. Upon receipt and verification, a refund will be issued within 5 working days.
9.6. Defective items are exchanged, repaired, or refunded in accordance with the Terms and laws.
10. Liability
10.1. The Buyer assumes full responsibility for the accuracy of the personal data provided. If the data provided in the registration form is inaccurate, the Seller is not liable for any consequences arising from this and has the right to demand compensation for direct damages incurred due to the Buyer’s error.
10.2. The Buyer is responsible for the actions performed using the Electronic Store and the Buyer’s Account.
10.3. The Buyer is responsible for keeping their login data confidential and for not disclosing it to third parties. If third parties use the services provided by the Electronic Store by logging in with the Buyer’s login data, the Seller considers this person the Buyer.
10.4. The Seller is not responsible for links to other companies', institutions', organizations', or individuals' websites provided in the Electronic Store and does not maintain or control their content.
10.5. In the event of damage, the guilty party compensates the other party for the direct damage.
11. Final Provisions
11.1. The Seller has the right to partially or completely suspend the operation of the Electronic Store without prior notice.
11.2. These Rules have been drawn up in accordance with the legal acts of the Republic of Lithuania.
11.3. The law of the Republic of Lithuania shall apply to relations arising under these Rules.
11.4. All disputes arising from the implementation of these Rules shall be resolved by negotiation. If an agreement cannot be reached, disputes shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
11.5. If any provision of these Rules is held to be illegal, invalid, or unenforceable under the laws of the Republic of Lithuania, that provision shall be deemed removed without affecting the validity and enforceability of the remaining provisions.
